AnswerStrong Terms and Conditions

Corporate Identity

The website and services available at answerstrong.com, including any related dashboards, applications, tools, communication services, phone-number services, automation features, and customer-support features, are provided by Thevisionary Publishing LLC, a Texas limited liability company, doing business as AnswerStrong.

In these Terms and Conditions, “AnswerStrong,” “we,” “us,” and “our” refer to Thevisionary Publishing LLC d/b/a AnswerStrong. “You,” “your,” “customer,” or “user” refers to any person or business that accesses the Site, creates an account, purchases a plan, uses our services, or otherwise interacts with AnswerStrong.

1. Acceptance of Terms

By accessing the Site, creating an account, purchasing a subscription, using our services, or authorizing another person to use our services on your behalf, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Site or our services.

You represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent.

2. Service Overview

AnswerStrong provides business communication services that may include professional business phone numbers, local and toll-free numbers, call forwarding, call routing, voicemail, voicemail-to-email, business hours and scheduling rules, usage dashboards, call logs, fax-related features, appointment-support tools, customer response automation, contact-form response tools, email and SMS follow-up features, knowledge-base supported responses, and Virtual Receptionist services.

Certain services may use artificial intelligence, automation, voice technology, speech recognition, transcription, call analysis, messaging tools, third-party communication providers, and related software to help answer calls, route inquiries, capture information, support scheduling, respond to customer questions, and improve business communication workflows.

All services, phone numbers, features, integrations, dashboards, usage tools, call minutes, messaging capabilities, AI-supported tools, and automation functions are subject to availability, provider limitations, network performance, regulatory requirements, technical limitations, and plan restrictions. We may modify, update, suspend, limit, replace, or discontinue any service, feature, integration, number, or functionality at our discretion.

3. AI-Supported Features and Limitations

AnswerStrong may provide AI-supported features, including but not limited to Virtual Receptionist responses, call handling, message drafting, customer intake, scheduling support, call summaries, transcription, call analysis, automated follow-up, and knowledge-base supported responses.

AI-supported features are designed to assist with communication and customer engagement. They are not guaranteed to be error-free, complete, uninterrupted, accurate, or suitable for every situation. AI-generated responses may misunderstand a caller, misinterpret information, omit details, produce incorrect information, or provide responses that require human review.

You are responsible for reviewing, testing, configuring, supervising, and approving how AI-supported features are used for your business. You are also responsible for ensuring that your business information, scripts, knowledge-base materials, appointment rules, pricing information, policies, and instructions provided to AnswerStrong are accurate, current, lawful, and appropriate.

AnswerStrong does not provide legal, medical, financial, emergency, professional, or regulated-industry advice through its AI-supported features. You agree not to rely on AI-supported features as a substitute for professional judgment, human review, emergency response, legal compliance, or direct customer service when such review or response is required.

4. User Responsibilities

You agree to provide accurate, current, and complete information during sign-up, onboarding, billing, number setup, Virtual Receptionist configuration, and while using the services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree not to use the services for any illegal, fraudulent, deceptive, abusive, threatening, harassing, defamatory, obscene, harmful, or unauthorized purpose.

You agree not to use the services for unlawful robocalling, unlawful robotexting, spam, phishing, scams, impersonation, harassment, deceptive marketing, illegal telemarketing, or any communication that violates applicable law.

You are responsible for your own compliance with all laws and regulations that apply to your business, industry, customers, communications, call recording, text messaging, email marketing, advertising, privacy, and customer consent obligations.

5. Call Recording, Monitoring, and Consent

Some AnswerStrong services may include call recording, call monitoring, transcription, call summaries, voicemail storage, or call analysis. Laws regarding call recording, monitoring, consent, notice, and disclosure vary by state, country, and situation. You are solely responsible for determining whether call recording, monitoring, transcription, or analysis is permitted for your business and for obtaining all required consents, notices, or permissions from callers, customers, employees, contractors, and any other parties. AnswerStrong may provide tools or settings related to call recording, transcription, or call analysis, but we do not guarantee that your use of those tools will satisfy your legal obligations. You agree not to enable or use call recording, transcription, or monitoring features unless you have determined that your use is lawful.

6. Messaging, Email, and Customer Communications

If you use AnswerStrong to send, trigger, automate, or assist with SMS messages, email messages, reminders, follow-ups, marketing messages, appointment messages, or customer responses, you are responsible for ensuring that such communications comply with all applicable laws, including consent, opt-out, identification, content, and recordkeeping requirements. You agree not to send or cause AnswerStrong to send unlawful, unsolicited, deceptive, abusive, or non-compliant messages. You are responsible for honoring opt-out, unsubscribe, stop, do-not-call, and similar requests from your customers or contacts. AnswerStrong may suspend, limit, or terminate messaging, email, phone, or automation services if we believe your use may violate law, carrier rules, provider rules, platform policies, or these Terms.

7. Phone Numbers, Porting, and Number Availability

AnswerStrong may provide access to local or toll-free business phone numbers, number-selection tools, call forwarding, routing, voicemail, fax-related features, and related communication services. Phone numbers are subject to availability, provider approval, carrier rules, number inventory, regulatory requirements, and technical limitations. We do not guarantee that any specific phone number, area code, prefix, toll-free number, or vanity number will be available. Unless otherwise required by law or agreed in writing, phone numbers provided through AnswerStrong may remain subject to the rules, limitations, and control of underlying carriers, providers, or telecommunications vendors. Number porting may be available in certain cases but is not guaranteed. Porting may require accurate account information, authorization, identity verification, carrier approval, and payment of any outstanding balances. We are not responsible for delays, rejections, errors, or failed porting caused by inaccurate information, third-party providers, carriers, customer account issues, or regulatory limitations.

8. Emergency Services and 911 Limitations

AnswerStrong is designed for business communication, customer response, call routing, and related workflow support. Unless expressly stated in writing, AnswerStrong is not intended to be used as an emergency calling service, life-safety system, medical-alert system, security-response system, or substitute for calling 911 or other emergency services. Certain internet-based, forwarded, virtual, toll-free, VoIP, or third-party communication services may have limitations with emergency calling, caller location, service availability, power outages, internet outages, routing, and E911 functionality. You agree not to rely on AnswerStrong as your sole method for emergency communication. You are responsible for maintaining appropriate emergency communication systems for your business.

9. Payments, Subscriptions, Usage, and Overage Fees

Subscription fees are due according to your selected plan and must be paid on time to avoid service interruption. Your plan may include a set number of minutes, messages, features, phone numbers, users, integrations, call recordings, storage limits, or other usage allowances. Usage beyond your plan may result in additional fees, overage charges, rate-based billing, feature restrictions, service limits, or required plan upgrades. Unless stated otherwise in a written agreement, all payments are non-refundable. We may suspend, limit, downgrade, or terminate service for non-payment, failed payment, chargebacks, billing disputes, excessive usage, suspected fraud, or violation of these Terms. Prices, plans, features, minute allotments, usage rates, overage fees, and billing structures may change from time to time. We will make reasonable efforts to provide notice of material pricing or plan changes when required or appropriate.

10. Third-Party Providers and Integrations

AnswerStrong may rely on third-party providers, carriers, software platforms, AI providers, voice providers, messaging providers, cloud-hosting providers, payment processors, email providers, CRM platforms, calendar tools, and other vendors to provide or support the services. You understand that third-party services may be subject to their own terms, policies, limitations, outages, pricing, restrictions, and data practices. AnswerStrong is not responsible for third-party outages, delays, service failures, errors, discontinued services, provider restrictions, carrier filtering, message blocking, number availability, API changes, integration errors, or other issues outside our reasonable control. We may add, remove, replace, modify, or disable third-party providers or integrations at any time.

11. Customer Data and Privacy

We are committed to protecting your personal information and business information. Please review our Privacy Policy for details on how we collect, use, store, disclose, and safeguard data. Depending on the services you use, AnswerStrong may process account information, billing information, business information, customer information, caller information, phone numbers, call logs, voicemail, recordings, transcriptions, messages, emails, appointment details, knowledge-base content, usage data, and related communication data. You represent that you have the necessary rights, permissions, notices, and consents to provide customer data, caller data, business data, uploaded content, and communication data to AnswerStrong for processing through the services. We do not sell your personal information. We may share information with service providers, vendors, carriers, payment processors, legal authorities, or other third parties as necessary to provide the services, comply with law, enforce these Terms, protect rights and security, process payments, or operate our business.

12. Security and Account Access

You are responsible for maintaining secure passwords, limiting account access to authorized users, and promptly notifying us if you believe your account has been compromised. We may take action to protect the services, including suspending access, requiring password resets, limiting usage, disabling integrations, or investigating suspicious activity. We do not guarantee that unauthorized third parties will never be able to defeat security measures. You agree to notify us immediately of any unauthorized use, suspected breach, or security concern related to your account or use of the services.

13. Intellectual Property

All content on the Site and within the services, including text, graphics, logos, icons, designs, software, workflows, dashboards, scripts, templates, documentation, and other materials, is owned by or licensed to Thevisionary Publishing LLC d/b/a AnswerStrong and is protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, misuse, or exploit any part of the Site or services without our prior written permission. You retain ownership of business information, customer information, uploaded content, scripts, documents, and materials that you provide to AnswerStrong. You grant AnswerStrong a limited license to use, host, process, transmit, display, and modify such materials as necessary to provide, maintain, support, secure, and improve the services.

14. Prohibited Uses

You may not use the Site or services to:

  • Violate any law, regulation, court order, carrier rule, or third-party right;

  • Send unlawful robocalls, robotexts, spam, phishing messages, or deceptive communications;

  • Impersonate another person, business, government agency, or entity;

  • Harass, threaten, defame, abuse, or harm any person;

  • Transmit malware, malicious code, or harmful content;

  • Interfere with or disrupt the services, networks, systems, or security features;

  • Attempt to gain unauthorized access to accounts, data, systems, or networks;

  • Use the services for emergency dispatch, life-safety, medical-alert, or high-risk purposes unless expressly authorized in writing;

  • Upload or transmit unlawful, infringing, sensitive, or restricted content without proper rights and authorization;

  • Misrepresent your business, offers, pricing, identity, or customer communications;

  • Use the services in a way that could cause carrier blocking, regulatory complaints, provider penalties, or harm to AnswerStrong’s reputation or operations.

15. Service Availability and Changes

We make reasonable efforts to provide reliable services, but we do not guarantee that the Site or services will be uninterrupted, error-free, secure, timely, or available at all times. Services may be affected by maintenance, updates, provider outages, internet issues, carrier issues, software errors, technical failures, power outages, cybersecurity events, regulatory requirements, or circumstances beyond our reasonable control. We may modify, suspend, limit, replace, or discontinue any part of the Site or services at any time, with or without notice, including for maintenance, security, compliance, provider changes, billing issues, or business reasons.

16. Service Suspension or Termination

We may suspend or terminate your account or access to the services at any time if you violate these Terms, misuse the services, fail to pay amounts due, create risk for AnswerStrong or our providers, violate applicable law, trigger carrier or provider restrictions, or if required by law. We may also suspend or terminate services to protect the security, stability, integrity, or reputation of AnswerStrong, our customers, our providers, or the public. Upon termination, you may lose access to your account, dashboard, phone numbers, call logs, recordings, voicemail, transcriptions, integrations, settings, and stored data, subject to applicable law and our data retention practices.

17. Disclaimers

The Site and services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, AnswerStrong disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted service. We do not guarantee that the services will increase revenue, prevent missed calls, produce any specific business result, book a specific number of appointments, convert leads, eliminate customer service issues, or operate without error. Any business, revenue, conversion, performance, or customer-service results depend on many factors outside our control, including your offer, pricing, market, staff, customer demand, scripts, business operations, configuration, and follow-up practices.

18. Limitation of Liability

To the fullest extent permitted by law, Thevisionary Publishing LLC d/b/a AnswerStrong shall not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages arising from or related to your use of or inability to use the Site or services. This limitation includes, without limitation, damages related to service interruptions, missed calls, lost revenue, lost profits, lost business opportunities, data loss, unauthorized access, call-routing errors, AI-generated errors, transcription errors, message errors, scheduling errors, customer disputes, number unavailability, failed porting, carrier blocking, third-party outages, or unauthorized use of your number or account. To the fullest extent permitted by law, AnswerStrong’s total liability for any claim arising out of or related to the Site, services, or these Terms shall not exceed the amount you paid to AnswerStrong for the services during the three months immediately preceding the event giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless Thevisionary Publishing LLC d/b/a AnswerStrong, its owners, officers, employees, contractors, vendors, service providers, and affiliates from and against any claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

  • Your use or misuse of the Site or services;

  • Your violation of these Terms;

  • Your violation of any law, regulation, carrier rule, or third-party right;

  • Your business communications, customer communications, scripts, offers, advertisements, or messages;

  • Your failure to obtain required consent for calls, messages, recordings, monitoring, or data processing;

  • Your customer data, uploaded content, business information, or instructions provided to AnswerStrong;

  • Any dispute between you and your customers, callers, employees, contractors, or business partners.

20. Changes to Terms and Conditions

We may update these Terms from time to time. Changes are effective upon posting to the Site unless a later effective date is stated.

Your continued use of the Site or services after updated Terms are posted constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Site and services.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

You agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas for any dispute arising out of or relating to these Terms, the Site, or the services.
